What is EUDR?

Regulation (EU) 2023/1115, also known as the EU Deforestation Regulation (EUDR), aims to reduce the European Union’s contribution to global deforestation and forest degradation. It applies to companies placing certain commodities or derived products on the EU market — or exporting them from the EU — when these goods are associated with deforestation, forest degradation, or illegal production practices.

Under the EUDR, operators and traders must carry out and submit a Due Diligence Statement (DDS) before placing relevant products on the market. This includes verifying that the products are both deforestation-free and legally produced in accordance with the country of origin’s laws. The regulation applies to key commodities such as soy, beef, palm oil, wood, cocoa, coffee, and rubber — as well as many of their derived products.

The goal of the EUDR is to ensure that supply chains linked to the EU market are both environmentally sustainable and transparent. Failure to comply may result in sanctions, fines, or restrictions. When is a Due Diligence Statement (DDS) required?

A Due Diligence Statement (DDS) is required under the EUDR if:

Placement

You place relevant products (covered by the regulation) on the EU market, whether they are imported or produced within the EU.

Scope

The products in question are listed in Annex I of the regulation (e.g. soy, beef, palm oil, wood, cocoa, coffee, rubber — and their derivatives).

Responsability

You are an operator or trader who is the first to place the products on the EU market.

Exemptions

The products are not exempted under simplified due diligence procedures (e.g. low-risk countries, as defined by the EU).

Traceability

You are involved in the sale or distribution of these products and need to ensure traceability and compliance.

Export

You export relevant products from the EU to a third country.

Deforestation date

The products were produced on land that may have been subject to deforestation or forest degradation after 31 December 2020.

Obligation to use TRACES-NT, the EU’s sanitary and phytosanitary certification platform

As part of the implementation of Regulation (EU) 2023/1115 on deforestation-free products (EUDR), companies subject to the regulation are now required to submit a Due Diligence Statement (DDS) before placing relevant products on the EU market or exporting them.

To ensure traceability and proper risk assessment, the European Commission has integrated the DDS submission process into TRACES-NT, its official sanitary and phytosanitary (SPS) certification platform. As a result, using TRACES-NT is mandatory for all operators and traders who need to comply with the EUDR.

Through TRACES-NT, companies must submit key information related to the origin of the products, geolocation of production plots, and confirmation that the goods are deforestation-free and legally produced. The platform ensures secure electronic submission, tracking, and regulatory compliance across EU member states.
Failure to use TRACES-NT for EUDR compliance — including the proper submission of DDS — may result in delays, non-compliance penalties, or market access restrictions.
